GENERAL TERMS AND CONDITIONS FOR CARDPAY SERVICE<\/h1>\n\n\n\n

General Terms and Conditions between the Portal Operator and the Donor (hereinafter referred to as the \u201eGTC\u201c).<\/p>\n\n\n\n

I. Definitions of Terms<\/h3>\n\n\n\n
    \n
  1. Operator<\/strong>\u00a0The portal nadaciaadeli.sk hosts Nad\u00e1cia ADELI, Hlbok\u00e1 45, 921 01 Pie\u0161\u0165any, Company ID: 42 400 970, Tax ID: 2024168355.<\/li>\n\n\n\n
  2. Darcom<\/strong>\u00a0Financial contributions via the internet are made by any natural or legal person who submits an electronic form published by the Operator via the internet (hereinafter referred to as the \u201eElectronic Form\u201c), thereby contributing any financial means to the rehabilitation stays of patients whose stories are published on the website .nadaciaadeli.sk. .<\/li>\n\n\n\n
  3. Financial contribution<\/strong> is the provision of any amount of money by the Donor for the benefit of the Operator for the purpose of financing the Patient's treatment.<\/li>\n\n\n\n
  4. Patient<\/strong>\u00a0I am a person with a physical disability whose story is published on the website nadaciaadeli.sk. .<\/li>\n\n\n\n
  5. Registration is the process of a Donor registering and simultaneously accepting these General Terms and Conditions by the Donor. An agreement on providing a financial contribution is simultaneously concluded electronically between the Donor and the Operator.<\/strong><\/li>\n\n\n\n
  6. Financial Contribution Agreement<\/strong> It is an agreement entered into by the Operator and the Donor. Under the Donor Contribution Agreement, the Donor gratuitously provides a Financial Contribution to the Operator, who accepts the Financial Contribution and shall further use it in accordance with the Foundation Charter.<\/li>\n<\/ol>\n\n\n\n

    II. Introductory Provisions<\/h3>\n\n\n\n
      \n
    1. The purpose of these GTC is to establish the principles of providing Financial contributions through nadaciaadeli.sk between the Operator and the Donor, and to define the rights and obligations of the Operator and the Donor.<\/li>\n\n\n\n
    2. These GTC apply mutatis mutandis to all Financial Means provided through nadaciaadeli.sk. Certain sections located on nadaciaadeli.sk may have their own defined GTC for use.<\/li>\n\n\n\n
    3. The website nadaciaadeli.sk facilitates the provision of financial resources from donors to patients. The operator provides technology to enable financial support for patients based on a transparent funding request.<\/li>\n\n\n\n
    4. Each donor is solely responsible for obtaining the information they need to decide whether to support a specific Patient. Basic information provided by the Patient to the Operator is published on nadaciaadeli.sk.<\/li>\n<\/ol>\n\n\n\n

      III. Rights and Obligations of the Donor<\/h3>\n\n\n\n
        \n
      1. Darca is entitled:
        a) voluntarily and free of charge provide a financial contribution for the patient.
        b) within one year of the provision of the Financial Contribution, request the Operator to prove the use of the provided funds (by providing copies of invoices or otherwise documenting the use of funds for the Patient's treatment). The Operator is obliged to comply with the Donor's written request within thirty days of its delivery.
        c) enter into an agreement or contract with the Operator for the provision of a Financial Contribution.<\/li>\n\n\n\n
      2. A donation is mandatory:
        a) provide accurate and truthful data and, upon request of the Operator, submit documents confirming this data. The Operator reserves the right to unilaterally withdraw from all agreements with the Donor due to the Donor providing inaccurate, false, or incomplete data and failing to correct, supplement, or provide evidence for said data within an additional period set by the Operator.
        b) deliver all statements, documents, data necessary and appropriate for the realization of its Financial Contribution.<\/li>\n<\/ol>\n\n\n\n

        IV. Rights and Obligations of the Operator<\/h3>\n\n\n\n
          \n
        1. The operator is obliged to:
          a) use the provided Financial Contributions for the benefit of the Patient at the time the Patient requests it based on their admission to a treatment stay.
          b) ensure the protection of provided information and payment security within the normal scope.<\/li>\n<\/ol>\n\n\n\n

          V. Transfer of funds<\/h3>\n\n\n\n
            \n
          1. All received financial contributions for an individual patient will be transferred by the Operator to the medical facility's account based on the issued invoice.<\/li>\n\n\n\n
          2. Darca is not entitled to interest on funds that have not yet been paid.<\/li>\n<\/ol>\n\n\n\n

            VI. Liability<\/h3>\n\n\n\n
              \n
            1. The operator bears no responsibility for the truthfulness, completeness, timeliness, and accuracy of the data published by Donors and Patient Stories on nadaciaadeli.sk. The providers of this data are responsible for it themselves.<\/li>\n<\/ol>\n\n\n\n

              VII. Protection and Use of Personal Data<\/h3>\n\n\n\n
                \n
              1. The Donor expresses consent in accordance with Act no. 122\/2013 Coll. on Personal Data Protection, as amended, to the administration, processing, and storage of personal data (the list of personal data is provided in the relevant Electronic Forms) and information by the Operator. The information will be processed and stored for the purposes of operating nadaciaadeli.sk, specifically for the purposes of registering Donors, registering individual Financial Resources, and the possibility of assigning these contributions to a specific Donor, for the realization of the provision of the Financial Contribution, or for other related purposes exclusively concerning the provision of a financial contribution to the Patient.<\/li>\n<\/ol>\n\n\n\n

                VIII. Governing Law and Dispute Resolution<\/h3>\n\n\n\n
                  \n
                1. Contracts concluded in accordance with these GTC shall be governed by the Civil Code and other legal regulations of the Slovak Republic. Disputes arising from them shall be settled by the locally and materially competent court of the Slovak Republic. The Operator shall not bear any responsibility related to the use of the contribution by the end recipient.<\/li>\n<\/ol>\n\n\n\n

                  IX. Final Provisions<\/h3>\n\n\n\n
                    \n
                  1. Darca and the Operator agree to fully recognize electronic communication, particularly via internet email, as valid and binding for both parties. Electronic communication is not acceptable in the case of objections regarding the use of donated Financial resources.<\/li>\n\n\n\n
                  2. By submitting the electronic form, the applicant confirms that they have read and fully agree with these T&Cs.<\/li>\n\n\n\n
                  3. Contributions will be paid according to the terms stated on the Operator's website on the day the Electronic Form with donated Financial Contributions is sent, unless otherwise expressly agreed between the parties.<\/li>\n\n\n\n
                  4. The operator reserves the right to change these GTC. The obligation to notify changes to the GTC in writing is fulfilled by placing them on the website nadaciaadeli.sk.<\/li>\n\n\n\n
                  5. These General Terms and Conditions are valid from December 1, 2014. The operator reserves the right to change the General Terms and Conditions without prior notice.<\/li>\n<\/ol>","protected":false},"excerpt":{"rendered":"
