Vážení darcovia,

vzhľadom na zachovanie transparentnosti financovania a prístupu Nadácie ADELI o darovaní 100% všetkých finančných prostriedkov na liečbu pacientov, by sme Vás radi upozornili na poplatky, ktoré nám bude banka strhávať z Vami darovaných financií prostredníctvom služby CardPay.

a) poplatky za platbu kartami, ktoré boli vydané bankami so sídlom v SR a pobočkami zahraničných bánk so sídlom v SR:

• 1,90 % z finančného daru pri platbe kartou MasterCard, MasterCard Electronic a Meastro
  o príklad: z daru 10 €, dostane pacient 9,81 € a poplatok banke je 0,19 €
• 1,50 % z finančného daru pri platbe kartou VISA, VISA Electron, V Pay
  o príklad: z daru 10 €, dostane pacient 9,85 € a poplatok banke je 0,15 €

b) poplatky za platbu kartami, ktoré boli vydané vydané zahraničnými bankami.

• 2,00 % z finančného daru pri platbe kartou MasterCard, MasterCard Electronic a Meastro
  o príklad: z daru 10 €, dostane pacient 9,80 € a poplatok banke je 0,20 €
• 2,00 % z finančného daru pri platbe kartou VISA, VISA Electron, V Pay
  o príklad: z daru 10 €, dostane pacient 9,80 € a poplatok banke je 0,20 €

c) Karty s logom Diners Club International

• 2,50 % z finančného daru
  o príklad: z daru 10 €, dostane pacient 9,75 € a poplatok banke je 0,25 €

Zúčtovacia mena je EUR.

I. Definitions of Terms

1. Operator portálu www.nadaciaadeli.sk je Nadácia ADELI, Hlboká 45, 921 01 Piešťany, IČO: 42 400 970, DIČ: 2024168355.
2. Darcom finančných prostriedkov cez internet je každá fyzická osoba alebo právnická osoba, ktorá odošle elektronický formulár zverejnený Prevádzkovateľom cez internet (ďalej len „Elektronický formulár“), a tým prispeje ľubovoľným finančným prostriedkom na rehabilitačný pobyt pacientov, ktorých príbehy sú zverejnené na stránkach www.nadaciaadeli.sk .
3. Financial contribution is the provision of any amount of money by the Donor for the benefit of the Operator for the purpose of financing the Patient's treatment.
4. Patient je osoba s telesným postihnutím, ktorej príbeh je zverejnený na stránke www.nadaciaadeli.sk .
5. Registration is the process of a Donor registering and simultaneously accepting these General Terms and Conditions by the Donor. An agreement on providing a financial contribution is simultaneously concluded electronically between the Donor and the Operator.
6. Financial Contribution Agreement It is an agreement entered into by the Operator and the Donor. Under the Donor Contribution Agreement, the Donor gratuitously provides a Financial Contribution to the Operator, who accepts the Financial Contribution and shall further use it in accordance with the Foundation Charter.

II. Introductory Provisions

1. Účelom týchto VZP je určiť zásady poskytovania Finančných prostriedkov prostredníctvom www.nadaciaadeli.sk medzi Prevádzkovateľom a Darcom a stanovenie práv a povinností Prevádzkovateľ a Darcu.
2. VZP sa vzťahujú primerane na všetky poskytnuté Finančné prostriedky poskytnuté prostredníctvom www.nadaciaadeli.sk. Niektoré časti umiestnené na www.nadaciaadeli.sk môžu mať definované vlastné VZP používania.
3. Internetová stránka www.nadaciaadeli.sk uľahčuje poskytovanie Finančných prostriedkov od Darcov pre Pacientov. Prevádzkovateľ poskytuje technológiu s cieľom umožniť finančnú podporu pre Pacientov na základe požiadavky transparentného financovania.
4. Každý darca je sám zodpovedný za získavanie informácií, ktoré potrebuje, aby sa rozhodol o podpore konkrétneho Pacienta. Základné informácie poskytnuté Prevádzkovateľovi zo strany Pacienta sú zverejnené na www.nadaciaadeli.sk.

III. Rights and Obligations of the Donor

1. Darca is entitled:
   a) voluntarily and free of charge provide a financial contribution for the patient.
   b) within one year of the provision of the Financial Contribution, request the Operator to prove the use of the provided funds (by providing copies of invoices or otherwise documenting the use of funds for the Patient's treatment). The Operator is obliged to comply with the Donor's written request within thirty days of its delivery.
   c) enter into an agreement or contract with the Operator for the provision of a Financial Contribution.
2. A donation is mandatory:
   a) provide accurate and truthful data and, upon request of the Operator, submit documents confirming this data. The Operator reserves the right to unilaterally withdraw from all agreements with the Donor due to the Donor providing inaccurate, false, or incomplete data and failing to correct, supplement, or provide evidence for said data within an additional period set by the Operator.
   b) deliver all statements, documents, data necessary and appropriate for the realization of its Financial Contribution.

IV. Rights and Obligations of the Operator

1. The operator is obliged to:
   a) use the provided Financial Contributions for the benefit of the Patient at the time the Patient requests it based on their admission to a treatment stay.
   b) ensure the protection of provided information and payment security within the normal scope.

V. Transfer of funds

1. All received financial contributions for an individual patient will be transferred by the Operator to the medical facility's account based on the issued invoice.
2. Darca is not entitled to interest on funds that have not yet been paid.

VI. Liability

1. Prevádzkovateľ nenesie žiadnu zodpovednosť za pravdivosť, úplnosť, aktuálnosť a presnosť údajov zverejnených Darcami a príbehmi Pacientov na www.nadaciaadeli.sk. Za tieto údaje zodpovedajú sami poskytovatelia týchto údajov.

VII. Protection and Use of Personal Data

1. Darca vyjadruje súhlas v súlade so zákonom č. 122/2013 Z.z. o ochrane osobných údajov v znení neskorších predpisov so správou, spracovaním a uchovávaním osobných údajov (zoznam osobných údajov je uvedený v príslušných Elektronických formulároch) a informácií Prevádzkovateľom. Informácie budú spracovávané a uchovávané na účely prevádzkovania www.nadaciaadeli.sk, a to na účely evidovania Darcov, evidovanie jednotlivých Finančných prostriedkov a možnosti priradenia týchto príspevkov ku konkrétnemu Darcovi, realizácie poskytnutia Finančného príspevku, prípadne na iné súvisiace účely týkajúce sa výhradne poskytnutia finančného príspevku Pacientovi.

VIII. Governing Law and Dispute Resolution

1. Contracts concluded in accordance with these GTC shall be governed by the Civil Code and other legal regulations of the Slovak Republic. Disputes arising from them shall be settled by the locally and materially competent court of the Slovak Republic. The Operator shall not bear any responsibility related to the use of the contribution by the end recipient.

IX. Final Provisions

1. Darca and the Operator agree to fully recognize electronic communication, particularly via internet email, as valid and binding for both parties. Electronic communication is not acceptable in the case of objections regarding the use of donated Financial resources.
2. By submitting the electronic form, the applicant confirms that they have read and fully agree with these T&Cs.
3. Contributions will be paid according to the terms stated on the Operator's website on the day the Electronic Form with donated Financial Contributions is sent, unless otherwise expressly agreed between the parties.
4. Prevádzkovateľ si vyhradzuje právo na zmenu týchto VZP. Povinnosť písomného oznámenia zmeny VZP je splnená umiestnením na internetovej stránke www.nadaciaadeli.sk.
5. These General Terms and Conditions are valid from December 1, 2014. The operator reserves the right to change the General Terms and Conditions without prior notice.
